  1. Nature of the consultancy: Research and advocacy services on migrants’ right to health to officials of the Government of the Kyrgyz Republic, the Republic of Kazakhstan, Turkmenistan and to IOM missions in these countries.

Context: The IOM Missions in the Kyrgyz Republic, in the Republic of Kazakhstan and in Turkmenistan is launching the regional project “Towards an Effective Migrants’ Right to Health in Central Asia: Assisting Governments in Enhancing the Provision of Health Services for Migrants”, (hereinafter referred to as the Project), implemented by IOM and funded by the IOM Development Fund. The main objective of the Project is to strengthen migrants’ right to health by increasing the availability and accessibility of health services for migrants in Central Asia through the development of comprehensive and evidence-based migration health policies and legislation in line with international norms and standards. This objective will be realized by conducting a comprehensive assessment of current legislative and policy frameworks related to migrants’ right to health, as well as conducting advocacy and capacity building activities with key government officials from relevant ministries and agencies. The Project will also study the migration behaviour of health professionals and students in Central Asia in order to understand the pull and push factors influencing the regional distribution of health professionals. Target countries are the Kyrgyz Republic, the Republic of Kazakhstan and Turkmenistan with expected participation from their respective ministries of health, education and migration agencies.

Objective of consultancy: contribute to the successful implementation of the IOM led research project “Towards an Effective Migrants’ Right to Health in Central Asia: Assisting Governments in Enhancing the Provision of Health Services for Migrantsby conducting an assessment of the legislative and policy frameworks related to migrants’ right to health in the Republic of Kazakhstan.

Targets:

  • Final version of the Kazakhstan legal and policy analysis chapter of the Assessment Report;

  • Input for the formulation of policy recommendations;

  • Presentations and participation in the framework of: 1) the Research Validation Meeting and 2) the Regional Workshop.

  1. IOM Project to which the Consultancy is contributing:

    Towards an Effective Migrants’ Right to Health in Central Asia: Assisting Governments in Enhancing the Provision of Health Services for Migrants

  2. Tasks to be performed under this contract:

    The Legal/Policy Analystwill be responsible for conducting an assessment of the legislative and policy framework related to migrants’ right to health in the Republic of Kazakhstan. He/she will work under the supervision and overall guidance of the IOM Project Manager and Principal Investigator.The Legal/Policy Analystwill conduct the assessment in Kazakhstan using a methodology designed by the IOM research team and based on the “Illustrative Indicators on the Rights of Migrants to the Enjoyment of the Highest Attainable Standard of Physical and Mental Health” (in Annex). He/she will coordinate with and report to IOM research team throughout the process.

    This entails the following tasks:

  • Conduct a preliminary desk review of available literature, data and other relevant documents related to migrants’ right to health in the Republic of Kazakhstan;
  • Produce a complete analysis of the legislative and policy frameworks related to migrants’ right to health in the Republic of Kazakhstan;
  • Assess the implementation mechanisms of these legislative and policy frameworks through interviews with experts and government officials (logistic assistance from IOM will be provided);
  • Provide input for the formulation of policy recommendations;
  • Prepare presentations and participate to the following events:
    • Research Validation Meeting (January 2016)
    • Regional Workshop (June 2017)

  1. Technical and behavioural requirements:

    1. Creates a respectful working environment free of harassment and retaliation, and promotes the prevention of sexual exploitation and abuse (PSEA);

    2. Effectively interfaces with government officials of appropriate level on matters related to substantive migration issues and the work of IOM;

    3. Effectively applies knowledge of migration issues within organizational context;

  2. Education and experience:

  • Advanced University Degree in Law, Political Science and/or other relevant fields;

  • At least 5 years of experience on conducting legal and policy analysis;

  • Experience in advocacy and in engaging with government officials;

  • Excellent analytical skills;

  • Understanding of migration health issues and related challenges;

  • Experience in working at or with international organizations an asset.
